Terms of Service

1. Service Description

TestPrep USA provides online test preparation services, including:

• Online Group Courses: Live instructor-led classes for SAT, ACT, AP, GMAT, GRE, LSAT, IMAT, IELTS, TOEFL and PTE Academic
• Private 1-on-1 Tutoring: Live online one-to-one lessons for every program on this site
• Private Groups: A group opened for 3 or more students. Each student buys their own place at the per-student price, with no start date to pick; once the group's students have paid, we set up the group and its timetable with them. For an exam with an open group course, a place costs the same as that course
• AP & IB Courses: Subject-specific preparation for Advanced Placement and International Baccalaureate exams
• International Exam Prep: IELTS, TOEFL, PTE, LNAT, IMAT, and UCAT preparation
• Practice Tests: Full-length practice tests for SAT, GMAT, GRE, IELTS, TOEFL and PTE Academic, with 2 attempts per test
• Study Resources: Digital materials, question banks and homework assignments

All services are delivered online through our platform and may include live video sessions, recorded content, interactive exercises, and downloadable materials.

2. Account Terms

Some services, such as the student area, require an account. By creating an account, you agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account
• Be at least 13 years of age (users under 18 require parental consent)

We reserve the right to suspend or terminate accounts that violate these terms or engage in prohibited conduct.

3. Payment & Refunds

Payment Terms

• All prices are listed in US Dollars (USD) unless otherwise specified
• Payment is required at the time of enrollment; for an installment plan, the first installment is taken at enrollment and the card is saved with Stripe for the rest, which are charged automatically one month apart. If a charge does not go through, we contact you to arrange it
• We accept major credit cards and other payment methods as displayed at checkout
• Lessons in a package stay valid until they have been used.

Refund Policy

To request a refund under this policy:

• Private tutoring: email info@testprepeurope.com after your first private lesson
• Group courses: email info@testprepeurope.com within the first week of the course
• Group courses we accept you into after the enrollment deadline: the first week begins with the first class you attend
• Provide feedback on why our services did not meet your expectations
• Refunds will be processed to the original payment method within 5-10 business days

Refund Exceptions

Refunds may not be available for:

• Requests made after the refund window above
• Digital materials that have been fully accessed or downloaded
• Private lessons already taught, other than the first lesson under the policy above
• After the first week, group course fees are not refunded. Each group is built around its enrolled students: the class size, the tutor and the timetable are set for them, and when one student leaves, the course changes for everyone else in the group. This does not affect your legal right to withdraw within 14 days of payment: if you withdraw in that period after lessons have started, the lessons already held are charged in proportion to the course and the rest is refunded.

Practice tests, question banks and AI Tutor time are digital content. You can ask for a refund of a digital product you have not used within 14 days of the payment date. A product counts as used once any practice test in the pack has been started, any question in a paid section of the question bank has been opened, or any second of AI Tutor time has been used; a used product is not refunded.

Lesson Cancellation

A private lesson can be cancelled or rescheduled up to 3 hours before it starts. A lesson cancelled later than that counts as taught and is not refunded, and a lesson whose fee is still unpaid 3 hours before it starts is cancelled automatically.

Every order on this site (private tutoring, group courses and private groups) is placed under our Terms of Sale and Pre-contract Information, which hold the 14-day right of withdrawal, our refund guarantees and the lesson cancellation rules; you accept them at checkout before you pay.

4. User Conduct

By using our services, you agree NOT to:

• Share Account Access: Your account is personal and non-transferable. Sharing login credentials with others is strictly prohibited
• Scrape or Copy Content: Use automated tools to extract, copy, or redistribute our exam questions, course materials, or any platform content
• Engage in Academic Dishonesty: Use our materials to cheat on actual exams, share live exam content, or assist others in cheating
• Disrupt Services: Interfere with the operation of our platform or other users' access to services
• Record Sessions: Record, screenshot, or distribute live tutoring or group class sessions without explicit permission
• Misrepresent Identity: Impersonate another person or provide false information
• Violate Laws: Use our services for any illegal purpose or in violation of applicable laws

Violation of these conduct rules may result in immediate account termination without refund.

5. Intellectual Property

All content on the TestPrep USA platform is protected by intellectual property laws:

• Exam Questions & Content: All practice questions, mock exams, and educational content are the exclusive property of TestPrep USA
• Curriculum & Materials: Course curricula, study guides, and teaching methodologies are proprietary
• Video Recordings: All recorded sessions, video lessons, and multimedia content are copyrighted
• Trademarks: The TestPrep USA name, logo, and branding may not be used without our written permission

You are granted a limited, non-exclusive, non-transferable license to access and use our materials solely for your personal, non-commercial educational purposes. This license does not include the right to reproduce, distribute, modify, or create derivative works.

6. Limitations of Liability

To the fullest extent permitted by law:

• TestPrep USA provides services "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for the specific service
• We are not responsible for third-party exam administration, scoring, or policies
• Technical issues beyond our control (internet connectivity, device compatibility) do not entitle users to refunds

7. Termination

Either party may terminate this agreement:

• By You: You may close your account at any time by contacting our support team
• By Us: We may suspend or terminate your account for violation of these terms, fraudulent activity, or extended inactivity

Upon termination, your access to courses and materials will cease.

8. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. We will notify registered users of material changes via email. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Miami-Dade County, Florida.
