2. Account Terms

To access our services, you must create an account. By creating an account, you agree to:

4. User Conduct

• Scrape or Copy Content: Use automated tools to extract, copy, or redistribute our exam questions, course materials, or any platform content
• Engage in Academic Dishonesty: Use our materials to cheat on actual exams, share live exam content, or assist others in cheating
• Disrupt Services: Interfere with the operation of our platform or other users' access to services
• Record Sessions: Record, screenshot, or distribute live tutoring or group class sessions without explicit permission
• Misrepresent Identity: Impersonate another person or provide false information
• Violate Laws: Use our services for any illegal purpose or in violation of applicable laws

Violation of these conduct rules may result in immediate account termination without refund.

5. Intellectual Property

All content on the TestPrep USA platform is protected by intellectual property laws:

• Exam Questions & Content: All practice questions, mock exams, and educational content are the exclusive property of TestPrep USA
• Curriculum & Materials: Course curricula, study guides, and teaching methodologies are proprietary
• Video Recordings: All recorded sessions, video lessons, and multimedia content are copyrighted
• Trademarks: The TestPrep USA name, logo, and branding are registered trademarks

You are granted a limited, non-exclusive, non-transferable license to access and use our materials solely for your personal, non-commercial educational purposes. This license does not include the right to reproduce, distribute, modify, or create derivative works.

6. Limitations of Liability

To the fullest extent permitted by law:

• TestPrep USA provides services "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for the specific service
• We are not responsible for third-party exam administration, scoring, or policies
• Technical issues beyond our control (internet connectivity, device compatibility) do not entitle users to refunds

7. Termination

Either party may terminate this agreement:

• By You: You may close your account at any time by contacting our support team
• By Us: We may suspend or terminate your account for violation of these terms, fraudulent activity, or extended inactivity

Upon termination, your access to courses and materials will cease. Unused tutoring hours may be forfeited unless otherwise agreed.

8. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. We will notify registered users of material changes via email. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Miami-Dade County, Florida.
